DRIVING

Stephen F. Austin State University shall ensure that none of the Express' employees are permitted to drive any vehicles or motorized equipment including forklifts. The term "vehicle" as used in this Agreement means a motor vehicle, trailer, semi-trailer and any other motorized mobile equipment (for example: forklift) designed for travel (or transportation purposes) on public roads, in warehouses, or any other locations at which such a vehicle would be used.

In the scope of vehicle use, the University shall ensure that Express' employees' job duties do not permit access to valuable property of any type or nature, including, but not limited to cash, securities, credit card numbers, charges, or account numbers.

FREEDOM OF ACCESS AND USE OF FACILITIES

Temporary employees provided by Express Personnel shall have reasonable and free access to use only those facilities of SFA that are necessary to perform services under the contract and shall have no right of access to any other facilities of SFA.

OBSERVANCE OF SFA POLICIES AND REGULATIONS

At all times temporary employees will observe and comply with all policies and regulations of the facilities, including, but not limited to, no smoking, parking, and security regulations.

ON-SITE INJURY OR ILLNESS

In the event a temporary worker is injured or becomes acutely ill while on duty at the University, the temporary worker and University supervisor will complete the Texas Worker's Compensation Commission (TWCC) form, Employer's First Report of Injury or Illness report. The University supervisor will retain a copy of the report for University records and forward the original report to Express Personnel. The temporary worker may seek medical attention from the provider of choice as instructed by the temporary service agency.

REFUSAL OF PLACEMENT

Refusal at Time of Placement

The SFA supervisor may refuse to schedule based upon review of the documentation listed above. The supervisor must notify Human Resources, x2304 of acceptance or rejection of each temporary within five (5) working days of submission of completed documentation. Human Resources MUST coordinate all refusals with the temporary service agency and will provide instructions to the supervisor.
The University reserves the right to interview candidates for the position.

Refusal During Placement

The SFA supervisor may request a replacement if the candidate chosen does not satisfactorily perform duties or their personality does not fit requirements as deemed necessary by this position. The SFA supervisor may request immediate removal of a temporary worker from SFA's facilities. The SFA supervisor must notify Human Resources, x2304 immediately and provide written documentation of any professionally unsatisfactory performance or conduct of the personnel. Human Resources MUST coordinate all refusals with the temporary service agency and will provide instructions to the supervisor.

Attendance

Standard working hours are expected to be 8:00am to 5:00pm, Mon.-Fri. excluding holidays and lunch hour (12:00-1:00pm). Exact times to be coordinated with the requesting department. No overtime will be allowed unless requested and approved by the requesting department. Some departments may require weekend work. When a temporary accepts an assignment it is to be understood that reporting on time is mandatory. If for any reason they cannot report for work, the temporary is to notify the department and Express Personnel. Temporary workers are expected to report to work in a fit and safe condition. They must be free of illegal drugs or alcohol while at work. Temporary workers taking prescription medications that impair ability to work safely are also subject to this provision.

SECURITY CHECK

Express Personnel shall be required to conduct a criminal background check upon request. The background check is to be completed prior to the person reporting to work or at anytime while the temporary worker is providing services to the University. The University department to whom the temporary worker is provided shall indicate the county(ies) for which the criminal background check is to be performed. The department shall be notified of the results of the report within 24 hours. Any temporary worker failing to pass the background criminal check will be immediately terminated and an acceptable replacement provided. Contractor shall not charge the University for a second criminal background check if one has been completed for SFA within the preceding (six) 6 month period unless specifically requested by the department. The University shall be promptly notified when the provided criminal background check was previously submitted.

SFA'S RIGHT TO HIRE

SFA reserves the right to hire furnished temporary worker(s) without being accessed a finder's fee penalty, after a temporary employee has been placed a minimum of 30 calendar days.

TEMPORARY WORKER INFORMATION

Express Personnel is strictly prohibited from filling a request with any person currently in the employment, either full-time or part-time, of SFA. Express Personnel must inform SFA departments of the name of any of its workers who are related to any SFA employee or is a past SFA employee. This must be done prior to any assignment to SFA.

SFA may require the temporary services agency to provide information relative to the request for a temporary worker such as certifications and licenses, conviction record if security sensitive, or health record if disability accommodations are requested. The SFA supervisor should make requests for this information through Human Resources.

SFA must be informed of any extenuating or extraordinary circumstances or qualifications regarding any temporary before they are sent on an assignment.
